Recovery Rooms

"Been Ripped Off? We'll Get Your Money Back!" These "recovery rooms" get the names of people who have been defrauded in other scams and then call, claiming to be federal attorneys or agents who can get your lost money back, for a fee. When the federal government sues scam artists, there is never a charge to consumers to return any money recovered.

Right to a Jury Trial

The Constitution of the United States and the State of New Mexico guarantee the right of trial by jury. Juries consist of six or twelve members depending on the court and type of case.

Who May Serve

Any person who is at least eighteen years of age, a United States citizen, a resident of New Mexico residing in the county for which a jury may be convened and is not a convicted felon is eligible and may be summoned for service by the district courts and magistrate courts unless the person is incapable because of physical or mental illness or infirmity to render jury service.

Selection of Jurors

Jurors are selected from a master data base of registered voters and driver’s license data bases maintained by the General Services Department of the State of New Mexico. Upon order of the court jurors are selected at random and jury summons mailer forms mailed to prospective jurors.

Exemption of Service

The following persons may be exempted from jury service:                             

persons incapable of serving because of physical or mental illness or infirmity; persons exempted from jury service at the discretion of the district court;

persons who have served as members of a petit jury panel or a grand jury in either the courts of the United States or the State of New Mexico, within the preceding thirty-six months are exempt from jury service in the courts of the state at the juror’s option; and

persons exempted from jury duty by the judge upon satisfactory evidence presented to him, although the person requesting to be excused need not be personally present in court when making the request.

Length of Service

A person is not required to remain a member of a jury panel for longer than six months.

Obligation of Employers

Employers who deprive their employees of employment or threaten or coerce them with respect to jury duty, upon conviction, are guilty of a petty misdemeanor.
